Initial bid offer of 5% of the current purchase price is accepted; payment by certified check or money order, only. Cash will not be accepted. If the minimum bid is less than $1,000, the bid deposit will need to be the entire amount.
The County submits a request to the City of Fayetteville to quitclaim the property to the County.
After the property has been deeded to the County, the offer will be submitted to next available Board of Commissioners' agenda.
After offer is accepted by the Board of Commissioners, it is advertised in the Fayetteville Observer for one day, which gives anyone 10 days to outbid. If outbid offer is submitted, the original bidder will be contacted and given the opportunity to submit another bid on the property.
After 10 day upset bid period, the County Attorney's Office will wait to receive an invoice for the Affidavit of Publication from the newspaper.
The County Attorney's Office submits an Approval of Sale to the next available Board of Commissioner's agenda.
When approved by the Board of Commissioners, the bidder will be contacted by mail to pay the balance, plus advertising fee, by certified check or money order within 30 days, and also pay separately $26.00 by money or certified check to the Cumberland County Register of Deeds to record the deed.
Once the balance and fees are received, the County Attorney's office will prepare a non-warranty deed and record it with the Register of Deeds.
